OVERVIEW

Welcome to Nookitt! Throughout the site, the terms “we”, “us” and “our” refer to Nookitt. Nookitt offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site.

 

Please read these Terms carefully. These Terms are governed by Portuguese Law, specifically Decree-Law no. 24/2014 and Decree-Law no. 84/2021.

 

SECTION 1 - ACCESS AND ELIGIBILITY

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state, or province of residence (18 years old in Portugal). You may not use our products for any illegal or unauthorized purpose. A breach or violation of any of the Terms will result in an immediate termination of your Services.

 

SECTION 2 - PRODUCTS AND THE 3-YEAR LEGAL WARRANTY

We make every effort to display as accurately as possible the colors and images of our products.

  • Legal Guarantee: Pursuant to Decree-Law no. 84/2021, all physical products sold to consumers residing in the European Union are covered by a legal warranty of three (3) years from the date of delivery.

  • Conditions: The warranty covers conformity defects existing at the time of delivery. It does not cover damage resulting from misuse, external accidents, normal wear and tear, or cat-inflicted damage outside of normal product durability.

SECTION 3 - ORDERS AND CONTRACT FORMATION

The display of products on our store constitutes an invitation to treat. Your order is an offer to purchase. The contract of sale is only concluded when we send you a Shipping Confirmation email. We reserve the right to refuse or limit any order at our sole discretion.

SECTION 4 - PRICES, VAT, AND BILLING

  • VAT (IVA): All prices displayed on Nookitt are inclusive of VAT at the legal rate currently in force in Portugal, unless otherwise stated.

  • Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases. We are not responsible for delivery failures caused by incorrect information provided by the customer.

SECTION 5 - SHIPPING AND INTERNATIONAL DELIVERY

By placing an order, you acknowledge that:

  • Transit Times: Products are shipped internationally. You explicitly agree to the delivery estimates provided in our Shipping Policy (which may range from 10 to 50 business days depending on the destination).

  • Agreement on Terms: Under EU law, delivery should occur within 30 days unless otherwise agreed. By accepting these Terms, you agree to the extended delivery window required for international transit.

  • Customs: Any additional customs duties or import taxes levied by the destination country are the sole responsibility of the customer.

SECTION 6 - RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF)

In accordance with Decree-Law no. 24/2014, if you are a consumer in the EU, you have the right to withdraw from this contract within 14 days without giving any reason.

  • Nookitt Extension: While the law requires 14 days, Nookitt offers a 30-day return window as part of our commitment to satisfaction.

  • Condition: Items must be returned unused, in original packaging, and with all tags. The customer is responsible for the direct cost of returning the goods.

SECTION 7 - ONLINE COMPLAINTS BOOK AND DISPUTES

In compliance with Portuguese Law (Decree-Law no. 74/2017):

  1. Electronic Complaints Book: You may submit a formal complaint via the official Portuguese platform: www.livrodereclamacoes.pt.

  2. Alternative Dispute Resolution (RAL): In case of a dispute, you may resort to an Alternative Dispute Resolution entity. Consumers may contact the Centro de Arbitragem de Conflitos de Consumo de Lisboa (CACCL) or the specific center in their area of residence. More information is available at www.consumidor.gov.pt.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products to you. You acknowledge that Shopify is a third-party service provider and is not responsible for the products, shipping, or the contract between you and Nookitt.

SECTION 9 - LIMITATION OF LIABILITY

To the maximum extent permitted by law, Nookitt shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products. Our total liability to you for any claim arising out of your purchase shall not exceed the amount paid for the product.

SECTION 10 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the Portuguese Courts.
